Request to Extend the Temporary Certificate of Occupancy

Dear Lanny,

This letter is to request that the City of Orange Beach extend the Temporary Certificate of Occupancy for Levin's Bend. We request that ninety (90) day extension be provided.

There are several issues that we are in the process of resolving. These items are as follows:

• Handrail: Bell has developed a design using an added "soldier" post. The current issues are color approval and some detailed layout issues. Bell advised that they expect to start installing the soldier post about December 10, 2007.

• Roof Trusses: Bell has hired the engineering firm TRC of Nashville to complete the design and submit engineered drawings. Bell advised that they anticipate that TRC will complete the design by November 16, 2007. Bell has committed to completing any corrective work immediately after Uzun & Case's approves TRC's engineered design.

• Hurricane Shutters: Bell has completed all of the design and is in the process of installing a mockup at the elevator and on the north face of Unit 100. Bell committed to completing the hurricane shutter work by December 31, 2007.

• Emergency egress from the emergency electrical room: For the west emergency electrical room, Bell has completed the rough installation of the cased opening so that this opening functions. Bell is in the process of finishing this opening.

• Emergency egress from the east residential trash room: Bell has installed the frame and door for the east residental trash room. Bell committed to completing the hardware installation on this door by November 21, 2007.
